Accuracy here is critical, as improper completion can lead to penalties or the rejection of the notarized document.</p><h3>3. <strong>Recording Incorrect Information in the Notary Journal</strong></h3><p>Maintaining a proper notary journal is not just a best practice&#8212;it&#8217;s required by law in Texas. In your journal, you must record the following for each notarization:</p><ul><li><p>Date of notarization</p></li><li><p>Signer's name</p></li><li><p>A description of the identification used to verify the signer&#8217;s identity (but <strong>not</strong> the ID number)</p></li><li><p>Whether you knew the signer personally or relied on a credible witness</p></li><li><p>Any fee charged (if applicable)</p></li></ul><p>Avoid recording sensitive information like ID numbers or biometric data, such as fingerprints. In Texas, it&#8217;s <strong>illegal</strong> to include thumbprints in your journal. Furthermore, keep your journal for at least three years after the last notarization or until your commission expires&#8212;whichever is longer.</p><h3>4. <strong>Not Administering Oaths or Affirmations Correctly</strong></h3><p>Administering an oath or affirmation requires the personal appearance of the individual in front of the notary. While raising the right hand is customary, it&#8217;s not required. The oath typically involves the signer swearing that the statements in the document are true, while an affirmation is made under penalty of perjury. If you&#8217;re administering an oath without a document, there&#8217;s no need to record the act in your journal&#8212;just ensure the signer understands the significance of their affirmation.</p><h3>5. <strong>Overstepping Legal Boundaries</strong></h3><p>As a notary public in Texas, your role is to verify signatures, witness documents, and confirm identities&#8212;not to provide legal advice. This includes:</p><ul><li><p>Preparing or drafting documents</p></li><li><p>Selecting which documents to notarize</p></li><li><p>Offering advice on legal matters</p></li></ul><p>Overstepping these boundaries can lead to serious consequences, including the suspension or revocation of your notary commission or even criminal charges.</p><h3>6. <strong>Improper Use of the Notary Seal</strong></h3><p>Your notary seal is a key tool of your profession, but it must be used correctly. Here are some key points to remember:</p><ul><li><p>Only use the name under which you were commissioned.</p></li><li><p>Maintain exclusive control over your seal at all times&#8212;never let others use it.</p></li><li><p>Don&#8217;t use an expired or invalid seal. For online notaries, failing to update digital certificates can also result in disciplinary action.</p></li></ul><p>Using a notary seal improperly&#8212;whether through oversight or intentional misuse&#8212;can result in penalties or the loss of your notary commission.</p><h3>7. <strong>Ignoring State-Specific Laws</strong></h3><p>This is a big one! Each state has its own rules for notaries, and just because something is allowed in another state doesn&#8217;t make it legal in Texas. That&#8217;s why I <strong>cannot stress enough</strong> the importance of getting state-specific training. This experience isn&#8217;t just about knowledge&#8212;it&#8217;s about how to make better decisions, interact with clients more effectively, and handle complex situations with calmness and professionalism. I&#8217;ve found that all of these traits work well together.</p><p>When I started my notary business in my early 50s, I quickly realized how beneficial my past experiences were. Years of working with people helped me relate to clients in ways younger notaries might struggle with. Whether you&#8217;re handling sensitive legal documents or providing guidance during a stressful loan signing, life experience gives you the ability to empathize and connect with clients on a deeper level. People often feel more comfortable and trust older individuals with important responsibilities.</p><p>In fact, I&#8217;ve had clients tell me I remind them of a close relative or family friend. One particularly memorable moment was when I visited a family&#8217;s home for a notarization. They had two young children, and the little boy told his sister, &#8220;You don&#8217;t have to be scared&#8212;it&#8217;s just a grandmother.&#8221; It was a cute reminder of how people often feel a natural sense of trust with someone older. This kind of rapport is invaluable for a notary, where trust and professionalism are key.</p><h2><strong>The Myth of Technology Being a Barrier</strong></h2><p>A common misconception is that older adults can&#8217;t adapt to new technology. However, technology today is more user-friendly than ever, and it&#8217;s not about being a tech expert&#8212;it&#8217;s about being willing to learn and adapt. If you can operate a smartphone or send an email, you can handle the technology required to run a notary business.</p><p>You don&#8217;t need to be a tech wizard to succeed. Running a local notary business is largely about building personal relationships and providing excellent customer service. If you decide to start a mobile notary business, as many over 50 do, technology simply becomes a tool to make things easier, not a barrier. You&#8217;ll mostly use it to manage appointments, track clients, and handle documentation&#8212;nothing overwhelming.</p><p>In fact, the Texas Secretary of State invited me to speak at a Texas notary conference a few years ago, where I gave a presentation on how to launch a mobile notary business (<a href="https://www.youtube.com/watch?v=pV6iPhOCXuA&amp;t=1s">link to presentation</a>). This was one of the key points I emphasized: technology is just an enabler, but the real focus should be on your people skills, professionalism, and life experience.</p><h2><strong>Experience Means Better Decision-Making and Customer Interaction</strong></h2><p>One of the most significant advantages of being 50+ in business is that we&#8217;ve honed our decision-making skills over the years. Experience teaches us how to think critically, solve problems efficiently, and deal with various situations. These are key traits that are incredibly valuable when running your own notary business. Younger entrepreneurs may still be learning these skills, but at 50+, we&#8217;ve had plenty of practice.</p><p>This experience also enhances how we interact with clients. I&#8217;ve encountered many notary clients dealing with situations I&#8217;ve personally experienced&#8212;whether it&#8217;s legal matters, family issues, or real estate transactions. Relating to their situations allows me to connect with clients on a deeper level, making them feel understood and cared for. This kind of customer interaction fosters trust and encourages repeat business.</p><p>Richard Pryor, the famous comedian, once said, &#8220;There is no such thing as a wise young man.&#8221; I feel he meant that wisdom comes from experience, and experience is something you earn over time. This resonates deeply with me because so much of what I&#8217;ve learned over the years has directly contributed to the success of my notary business.</p><h2><strong>Starting a Business After 50: A New Purpose</strong></h2><p>Another common misconception is that starting a business later in life means you&#8217;re &#8220;too late to the game.&#8221; But the truth is that many successful businesses are built on the foundation of years of experience and wisdom.
